This STALLION BREEDING CONTRACT for the breeding season of 200   , is made and entered into on this

 _______ day of ____________, 2008, by and between Nicole Alley, owner of the Triangle A Paint Horses, hereinafter designated Stallion Owner, and

______________________________________, hereinafter designated Mare Owner.

Mare Owner agrees to breed the mare _________________________ Breed _______________________ Reg. # ________________for a fee of $__________, for a live foal to the stallion Hotshot Ashwood _______________________________________

subject to the following conditions:

1. The breeding fee includes a non-refundable booking fee of $_______ payable upon execution of this contract. The balance of this fee and all other expenses must be paid when the mare is picked up. Mare Owner may not remove mare from Breeding premises until all expenses are paid in full.

2. Stallion owner agrees to provide suitable facilities for the care and feeding of mare or mare with foal while in our custody. Mare Owner agrees to pay for care and feed at ______ per day per mare, wet or dry.

3. Stallion Owner will exercise judgment consistent with recognized standards in care and supervision of mare, or mare and foal. Stallion Owner assumes responsibility of arranging veterinarian and farrier services as necessary. All veterinarian and farrier expenses will be paid by Mare Owner.

4. Mares that are not halter broken will not be accepted.

5. The mare shall be in a healthy and sound breeding condition, free from infectious, contagious, and transmittable diseases. A photo copy of mare's registration papers should accompany this signed Contact. A current Coggins Test must accompany mare.. Mare is not to wear any shoes. Stallion Owner reserves the right to refuse mare if not in satisfactory condition. If mare is refused, the booking fee shall be refunded.

6. Stallion Owner agrees to diligently try to settle mare; however, if mare fails to settle, for any reason, Mare Owner will hold Stallion Owner blameless. Mare Owner agrees to give Stallion Owner ample opportunity to settle mare. If mare cannot be settled, Stallion Owner will allow a substitution of mares at its discretions, according to paragraphs 4 and 5 above.

7. This Contract contains a "Live  Foal Guarantee". A live foal is described as a newborn foal which stands and nurses, excluding a "lethal white" foal. IF a foal is born dead, or is after being pronounced "safe in foal", the mare should miscarry, abort, or prove barren after leaving the premises of Triangle A, there are return privileges for the 2009 Breeding season only. All dead/lethal white borne foals rebreeds must be accompanied by a vegetarian statement stating the birth of a  dead/lethal white foal. These privileges are only valid for the mare's current owner and signer of this contract, and are non-transferable. Stallion Owner will allow a substitution of mares at its discretion, according to Paragraphs 4 and 5 above. Mare Owner agrees to pay $4.00 per day for mare care during re-breed.

8. A "Breeder's Certificate" will be issued for the foal, conceived by this mating, when stallion fee and all other expenses have been paid in full, and the mare delivers a live foal by this mating. DNA  testing for mare and/or foal is Mares Owners responsibility and has to be done at Mares Owners expense if DNA testing is required by APHA or AQHA.

9. All parties agree the Stallion Owner, their agents or employees, are not liable for death, sickness, or accident including consequential damages caused to the mare and/or foal, and Mare Owner is not liable for death, sickness or accident including consequential damages caused to the stallion.

10. It is further agreed that should the stallion die, be sold by the owner, or become unfit for service prior to settling the mare, that the booking fee will be refunded if it has been paid in full, thereby canceling this entire contract. If the mare dies or becomes unfit to breed, the Stallion Owner had the option to accept another mare according to Paragraphs 4 and 5 as a replacement, or refund the booking fee if paid in full, thereby canceling this contract.

11. This Contract is non-assignable and non-transferable. The Mare Owner is responsible for all personal property taxes and full insurance on the mare and foal.

12. This Contract is entered into in the Sate of Missouri and will be interpreted and enforced under the laws of that state. If any clause in this Contract is against State Law, then that clause shall be null and void, having no effect on the remainder of the Contract.

13. Should either party breach this Contract, the breaching party shall pay for the other's court costs and reasonable attorney's fees related to such breach. Any suit shall be filed in DeKalb County, Missouri.

14. This Contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included unless specifically stated in this written Contract. Additional conditions should be individually initialed by each party.

Additional Additions:

When Stallion Owner and Mare Owner sign this contract, it will be binding on both parties, subject to the above terms and conditions.
